NOTICE TO BIDDERS PUBLIC NOTICE IS HEREBY GIVEN that the City of Vacaville is inviting sealed proposals for furnishing all tools, materials, labor, and services necessary to complete the Wells 18, 19, and 20 Electrical Prepurchase Project, including all items and appurtenances as described in the project plans and specifications. The City will receive such bids in the office of the City Clerk (Attn: Benjamin Menzel), City of Vacaville, 650 Merchant Street, Vacaville, CA 95688, up to the hour of 2:30 P.M. on September 3, 2025, at which time the bids received will be publicly opened and announced. Bidders are solely responsible for ensuring timely delivery. Late proposals will be returned unopened. The work under this contract includes, but is not limited to, the procurement of power distribution and control equipment, instrumentation, and testing and startup services for the City's Wells 18, 19, and 20 Electrical Prepurchase Project ("Project"), which is part of the larger Wells 18, 19, and 20 Equipping Project. The well sites are located within the City of Vacaville, Solano County, California. Bidders are encouraged to inspect the project sites and familiarize themselves with all conditions affecting the work. Pursuant to California Public Contract Code Section 3400, bidders may propose equals of products listed in the technical specifications by manufacturer name, brand or model number; unless the technical specifications or plans specify that the product is necessary to match others in use. Bid documents, including plans, specifications, and instructions to bidders, are available electronically on the City's website at https://www.cityofvacaville.gov/government/finance/purchasing. Addenda, if issued, will also be posted on the City's website. Each bid must be accompanied by a bid bond, cashier's check, certified check, or cash deposit in an amount not less than ten percent (10%) of the total bid, payable to the City of Vacaville. The bid security will be forfeited as liquidated damages if the successful bidder fails to execute the contract and furnish required bonds within ten (10) calendar days of the award. The City reserves the right to reject any or all bids, to waive any irregularities or informalities, to take all bids under advisement for a period of 60 calendar days if necessary, and to award the contract to the lowest responsive and responsible bidder whose proposal is in the best interest of the City. Bids that are obviously unbalanced may be rejected, in accordance with applicable state laws and regulations. The contract will be subject to the nondiscrimination and compliance requirements of the California Government Code, Sections 1290012996. The City hereby notifies all qualified bidders that it will affirmatively ensure that qualified minority business enterprises will be afforded full opportunity to submit bids in response to this invitation and will not be discriminated against on the basis of race, color, national origin, ancestry, sex, religion, or handicap in consideration for an award. Attention is directed to the provisions of Section 1777.5 (Chapter 1411, Statutes of 1968) and 1777.5 of the Labor Code concerning the employment of apprentices by the Contractor's or any such subcontractors under hire. The bidders and the selected Contractor shall not allow discrimination in employment practices on the basis of race, color, national origin, ancestry, sex, religion, or handicap. Any contract entered into pursuant to this notice will incorporate the provisions of the California Labor Code. Compliance with the prevailing rates of wages and apprenticeships employment standards established by the State Director of Industrial Relations may be required. The successful Contractor and any subcontractors will be required to possess business licenses from the City. To comply with SB 854, the following language shall be deemed to apply to the extent a portion of the Project involves a public work as defined by state law: (1) No contractor or subcontractor may be listed on a bid proposal for public works project (submitted on or after March 1, 2015) unless registered with the Department of Industrial Relations (DIR) pursuant to Labor Code section 1725.5 [with limited exceptions from this requirement for bid purposes only under Labor Code section 1771.1(a)]. (2) No contractor or subcontractor may be awarded a contract for public works on a public works project awarded on or after April 1, 2015, unless registered with the DIR. (3) The project is subject to compliance monitoring and enforcement by the DIR. (4) Require the prime contractor to post job site notices prescribed by regulation (regulation not created yet) or the City must post the notices itself. The contractor shall fill in the Department of Industrial Relations (DIR) Contractor Registration Number Form where requested and submit it with the sealed bid. Any contract entered into pursuant to this notice shall become effective or enforceable against the City of Vacaville only when the formal written contract has been duly executed by the appropriate officers of the City.
